1. Scope & Acceptance

a) Client as Data Controller:

  • Our Clients own any personal or business data they input or otherwise process through our Services.

  • Clients have full control over how they collect, use, disclose, or otherwise process such data.

b) TechLabCo as Service Provider / Processor

  • We act as a service provider (or “data processor” under laws like the GDPR) on behalf of our Clients.

  • We process data solely for the purpose of providing and maintaining the Services according to agreements with each Client. We do not otherwise use or disclose this data except as instructed by the Client or required by law.

3. Information We Collect

a) Information Provided by Clients

  • Client Account Details: When a Client signs up or manages their account, we collect business contact information (name, email, phone), and billing details.

  • AI Calling Content: The substance of calls or transcripts may be processed through our AI solution under the Client’s direction.

  • Support Requests: When Clients contact us for support, we collect relevant details to address their inquiries.

b) Information Automatically Collected

  • Log and Usage Data: We may automatically gather technical data such as IP address, browser type, device details, and usage patterns for troubleshooting, analytics, and service improvements.

  • Cookies & Similar Technologies: Our platform may use cookies or similar tracking tools to remember Client sessions, preferences, and to collect aggregated usage statistics.

Note: Any personal information contained in client call data is owned and controlled by the Client. Our role is limited to processing such data on behalf of the Client.

4. How We Use Information

We use information in accordance with our contractual obligations to Clients and applicable law. Specifically, we use data to:

  • Provide, Maintain & Secure the Services: Enable core features of the AI calling solution, perform troubleshooting, and protect against unauthorized access or misuse.

  • Support & Communicate with Clients: Respond to Client questions, technical issues, and provide relevant updates or changes to the Services.

  • Analyze & Improve: Gather aggregated or de-identified usage data to enhance platform performance, reliability, and user experience.

  • Comply with Legal Obligations: Meet any legal or regulatory requirements, respond to law enforcement requests, or defend our legal rights.

5. Sharing & Disclosure

We share data only in the following circumstances:

a) Service Providers

6. Client Responsibility & Indemnification

a) Client Liability

  • Clients are solely responsible for ensuring their collection and use of data (including call recordings, transcripts, or personal information) complies with all applicable laws, regulations, and industry standards.

  • Clients must obtain any necessary consents, provide required notices, and handle individual privacy rights requests as mandated by relevant laws (e.g., GDPR, CCPA/CPRA, or call recording statutes).

b) Indemnification

By using our Services, Clients agree to indemnify, defend, and hold harmless TechLabCo and its affiliates from any and all claims, liabilities, or damages (including legal fees) arising out of or related to:

  • the Client’s use of the Services,

  • the Client’s violation of any applicable laws or regulations, and

  • any disputes or legal actions involving Client data processing through our Services.

c) Disclaimer of Liability

  • TechLabCo is not liable for any damages, fines, or legal consequences resulting from a Client’s noncompliance with applicable laws or misuse of our Services.

  • Clients acknowledge and agree that TechLabCo provides the AI calling solution “as is,” without warranties of any kind regarding compliance or fitness for the Client’s particular legal obligations.

7. Data Retention & Security

a) Data Retention

  • We retain Client account information as long as needed to provide the Services or as required by law.

  • Clients control how long their data (e.g., call content) is stored on our systems, subject to any retention settings within the platform or contractual terms.

b) Security Measures

  • We implement industry-standard security safeguards, including access controls, encryption (where appropriate), and system monitoring, to protect against unauthorized disclosure or misuse of data.

  • No Method Is 100% Secure: While we strive to protect all data, we cannot guarantee absolute security.

8. International Data Transfers

If you access the Services from outside the United States, be aware that your information (including personal data) may be transferred to and stored in the United States or other jurisdictions where our service providers or we operate. c) Opt-Out of Marketing

Clients or prospective Clients may unsubscribe from marketing communications at any time by following the unsubscribe link or emailing us directly.

We may update this Privacy Policy periodically to reflect changes in our business practices, legal requirements, or for other purposes. When we do, we will post the revised version with a new “Last Updated” date.
